Agreement to Terms

By downloading, installing, or using SambaSync ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.

SambaSync is developed and distributed by Nectar Mobile Development ("we," "us," or "our"). These terms govern your use of the App.

License to Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use SambaSync on your Android device for its intended purpose: automatically uploading files from your device to your network storage (NAS).

You may:

• Install and use the App on devices you own or control
• Use the App for personal or commercial purposes
• Configure the App to upload files to your own network storage

You may not:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices from the App
• Use the App for any illegal purposes
• Distribute or sell the App to others

Intended Purpose

SambaSync is designed to upload files from your Android device to network storage that you own and control. The App is intended for legitimate backup and file synchronization purposes. You are responsible for ensuring you have the right to upload the files you choose to sync and that you have permission to access the network storage you configure.

Background Operation

SambaSync uses scheduled background tasks to perform file synchronization at times you configure. To run reliably, the App may request permission to schedule exact alarms, run foreground services for data synchronization, and be exempt from battery optimization restrictions. These capabilities are used solely to ensure your configured sync schedule runs as expected, including when your device is asleep or in battery saving mode. You may revoke these permissions at any time through your device settings, though this may reduce the reliability of scheduled syncs.

AS-IS Warranty Disclaimer

SAMBASYNC IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• Files will be uploaded successfully in all circumstances
• The App is compatible with all devices or network configurations

The App is sold to you, the consumer, with the features as advertised. We make no guarantees beyond the functionality described in the App's listing on the Google Play Store.

Your Responsibility

You are solely responsible for:

• Maintaining backups of your important files through other means
• Ensuring your network storage is properly configured and accessible
• Securing your network credentials and NAS access
• Monitoring uploads to ensure they complete successfully
• Compliance with any applicable laws regarding file storage and transfer

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NECTAR MOBILE DEVELOPMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Failed or incomplete file uploads
• Loss or corruption of files
• Unauthorized access to your network storage
• Any other matter relating to the App

No Online Services

SambaSync does not include any online services, cloud storage, or servers operated by us. The App creates a direct connection between your device and your network storage. We are not responsible for the availability, security, or operation of your network storage.

Updates and Modifications

We may update the App from time to time to add features, fix bugs, or improve performance. Updates may be provided through the Google Play Store. We reserve the right to modify or discontinue the App at any time without notice.

Termination

You may stop using the App at any time by uninstalling it from your device. Your license to use the App terminates automatically if you violate these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

Intellectual Property

SambaSync and all related trademarks, logos, and branding are the property of Nectar Mobile Development. These Terms do not grant you any rights to our intellectual property except for the limited license to use the App as described above.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nectar Mobile Development operates, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nectar Mobile Development regarding the use of SambaSync.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will update the "Last Updated" date above and post the new Terms on this page. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
