Welcome to NidoNotes! These terms and conditions outline the rules and regulations for the use of NidoNotes' Website, located at NidoNotes.com. NidoNotes is developed and operated by Nectar Mobile Development.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use NidoNotes if you do not agree to take all of the terms and conditions stated on this page.

1. Introduction

  2. By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.

2. User Information and Data

  1. Upon signup, NidoNotes collects user profile data including name, email, age, address, and location. This data is refreshed at each login to ensure accuracy and completeness.
  2. By providing us with your information, you consent to us collecting, holding, using, and disclosing your personal information in accordance with our Privacy Policy.
  3. We are committed to protecting your privacy and will handle your data in accordance with applicable laws and regulations.
  4. We do not want Personally Identifiable Information (PII) data uploaded to our server. The application is designed to handle data related to physical objects and their identifiers. While we take every precaution to keep data secure, we do not expect to be housing and protecting PII.

3. User Content and Conduct

  1. Users are allowed to upload photos of items in their homes, including but not limited to paint colors, furniture, and light fixtures. Our AI processes the details of these items and stores the data in PostgreSQL.
  2. Users retain ownership of the content they upload and can use their data as they wish.
  3. Users agree not to upload or share content that is illegal, obscene, offensive, or disturbing. This includes content that:
    • Promotes or contains hate speech, violence, or discrimination.
    • Violates any laws or regulations.
    • Contains explicit or sexually suggestive material.
    • Is fraudulent or deceptive.
  4. NidoNotes reserves the right to remove any content that violates these terms and conditions, and to terminate the accounts of users who repeatedly violate these guidelines.

4. Data Sharing

  1. NidoNotes reserves the right to share data stored in the system at its sole discretion.
  2. We may share user data for purposes including but not limited to:
    • Improving our services and features.
    • Collaborating with partners and third parties to enhance user experience.
    • Complying with legal obligations or requests from governmental authorities.
    • Protecting the rights, property, or safety of NidoNotes, its users, or the public.
  3. Any data sharing will be conducted in accordance with our Privacy Policy and applicable data protection laws.

5. Intellectual Property Rights

  1. Unless otherwise stated, NidoNotes and/or its licensors own the intellectual property rights for all material on NidoNotes. All intellectual property rights are reserved.

    • Republish material from NidoNotes.

  1. NidoNotes will not be liable for any loss or damage of any nature.

7. Purchases and Application Lifetime

  1. Some NidoNotes features are offered as paid purchases, including one-time ("lifetime") purchases. A one-time or lifetime purchase grants access for the lifetime of the application: the period during which Nectar Mobile Development continues to operate and support NidoNotes. "Lifetime" refers to the supported life of the application, not to the life of the purchaser.
  2. Nectar Mobile Development is an independent, single-developer operation. We may modify, suspend, end support for, or decommission NidoNotes (or any feature) at any time, at our sole discretion, for any reason — including that continuing the service is no longer commercially viable.
  3. Notice of a decommission or end of support is posted on our website at nectarmobile.dev. We are not required to provide such notice within the application itself. Check nectarmobile.dev for the current status of the application.
  4. You may export your data from within the application at any time, and we recommend doing so before a posted decommission date.
  5. Discontinuation of the application at the end of its supported life does not, by itself, entitle you to a refund, except where required by applicable law.

8. Changes to Terms and Conditions

  1. NidoNotes reserves the right to revise these terms and conditions from time to time. Updated terms, and any legal notices concerning the application (including decommission or end-of-support notices), are posted on nectarmobile.dev. Posting there constitutes sufficient notice; we are not required to provide notice within the application.

  1. These terms and conditions are governed by and construed in accordance with the laws of USA and Maine, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
