Agreement to Terms
By downloading, installing, or using Demo Day ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the App.
Demo Day is developed and distributed by Nectar Mobile Development ("we," "us," or "our"). These terms govern your use of the App.
Purchase and Lifetime License
Demo Day is a one-time purchase. Your purchase gives you a license to use the App for the lifetime of the application: for as long as Nectar Mobile Development continues to support and distribute Demo Day. "Lifetime" refers to the supported life of the App, not to the life of the purchaser or of any particular device.
Nectar Mobile Development is an independent, single-developer operation. We may end support for, stop distributing, or decommission the App at any time, at our sole discretion, for any reason, including that continuing it is no longer commercially viable. Notice of a decommission or end of support is posted on this website (nectarmobile.dev), not inside the App.
Demo Day runs entirely on your device with no online services operated by us, so a copy you have installed keeps working after support ends; it simply stops receiving updates. End of support does not, by itself, entitle you to a refund, except where required by law or by Google Play's policies. Purchases are made through Google Play, and refunds are handled under Google Play's refund policies.
License to Use
We grant you a personal, non-exclusive, non-transferable, revocable license to use Demo Day on your Android devices for entertainment.
You may not:
- Modify, reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices from the App
- Use the App for any illegal purposes
- Distribute or sell the App to others
A Game, Not a Simulation
Demo Day is a work of fiction. Its buildings, weapons and defences are cartoon pixel art and do not depict real places, people or events.
AS-IS Warranty Disclaimer
DEMO DAY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The App will be error-free or uninterrupted
- Defects will be corrected
- The App is compatible with all devices or Android versions
- High scores or settings will be preserved across reinstalls or devices
The App is sold to you, the consumer, with the features as advertised. We make no guarantees beyond the functionality described in the App's listing on the Google Play Store.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NECTAR MOBILE DEVELOPMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP, OR ANY OTHER MATTER RELATING TO THE APP.
No Online Services
Demo Day does not include any online accounts, leaderboards, cloud storage, or servers operated by us. High scores are kept only on your device.
Updates and Modifications
We may update the App from time to time to add features, fix bugs, or improve performance. Updates may be provided through the Google Play Store. We reserve the right to modify or discontinue the App at any time, at our sole discretion (see "Purchase and Lifetime License").
Termination
You may stop using the App at any time by uninstalling it from your device. Your license to use the App terminates automatically if you violate these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
Intellectual Property
Demo Day and all related logos and branding are the property of Nectar Mobile Development. These Terms do not grant you any rights to our intellectual property except for the limited license to use the App as described above.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nectar Mobile Development operates, without regard to its conflict of law provisions.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nectar Mobile Development regarding the use of Demo Day.
Changes to These Terms
We reserve the right to modify these Terms at any time. If we make changes, we will update the "Last Updated" date above and post the new Terms on this page. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
